This document sets out the Terms and Conditions ("T&C") governing the contracting and use of the Account Ownership Verification Portal ("SVTC Portal") marketed by YOiD Identidad Digital, S.L. ("YOID"), with registered address at Calle Sollube 22, 48993 Getxo (Vizcaya), Spain, a payment institution authorized by the Bank of Spain.
The SVTC Portal allows the client ("Client") to verify, through the VALITIC scheme managed by Sociedad Española de Sistemas de Pago, S.A. ("Iberpay"), whether the registered holder of a bank account identified by its IBAN matches the identity document number (NIF/DNI/NIE/passport) provided.
Client payment account. The service offered by YOID is built on the technological base of payment-account infrastructure. Accordingly, prior to or simultaneously with the service onboarding, YOID will open a payment account in the Client's name with its corresponding IBAN, which the Client will have at its disposal and may use freely within the scope of the service, and whose access credentials will be provided together with the Portal access credentials.
Acceptance of these T&C occurs when the Client checks the acceptance box during the contracting process. These T&C constitute the entire agreement between YOID and the Client for use of the SVTC Portal, and no additional contract shall exist unless agreed in writing and signed by both parties.
2.1 Data required per query. To carry out a verification, the Client must enter the following three items of data into the Portal:
If any of this data is not provided or contains a format error, the query will be rejected before processing and no fee will accrue. If the data is formally correct but its content is inaccurate, the query will be processed in full and the corresponding fee will accrue regardless of the result obtained (OK or KO). Verifying the accuracy of the data's content is the Client's sole responsibility.
2.2 Verification process. Once submitted, YOID forwards the query to Iberpay, which in turn passes it on to the bank issuing the account (Requested Entity). The Requested Entity's response is returned to the Client through the Portal in real time.
2.3 Possible results. The Portal's response will exclusively be one of the following:
2.4 Fee accrual. Each query correctly submitted to Iberpay accrues the fee corresponding to the contracted plan, regardless of whether the result is OK or KO. No fee will accrue only in cases of rejection due to a format error prior to processing. Accrued queries will be deducted from the monthly limit included in the plan or, if that limit has been exceeded, will be billed at the published additional-query price.
2.5 Portal access and credentials. YOID will provide the Client with Portal access credentials within a maximum of 24 business hours from payment confirmation. Credentials are personal and non-transferable and their use is restricted to the authorized person designated during the contracting process. The Client is responsible for all activity carried out using its credentials. In the event of loss, theft or unauthorized use, the Client shall immediately notify YOID at clientes@yoid.es.
2.6 Support and incidents. For queries, technical incidents or service-related notifications: soporte@yoid.es. To report suspected fraud or misuse: fraude@yoid.es. The Client agrees to notify YOID, as promptly as possible, of any request from supervisory authorities related to use of the service.
2.7 History and export. The Portal logs all queries carried out by the Client, with date, time and result. This history is available for review and export for the duration of the contracted plan. YOID does not guarantee the availability of the history once the subscription has been cancelled.
The SVTC Portal operates through Iberpay's infrastructure, to which participating Spanish banks voluntarily adhere under the VALITIC scheme. YOID cannot guarantee full coverage of the Spanish banking system nor the permanent availability of the service, given its dependence on Iberpay's infrastructure and on the banks issuing the queried accounts.
The result of each query is exclusively "MATCH" or "NO MATCH" with respect to the NIF/CIF provided, and is purely informational. The Client is solely responsible for the decisions it makes based on that result. The service does not replace the Client's internal procedures (KYC/AML, documentary verification or others).
YOID shall not be liable for the lack of response from entities not adhering to the VALITIC scheme, for incidents in Iberpay's infrastructure, or for interruptions caused by maintenance operations. In any event, YOID will act with due diligence to resolve incidents within its control.
The Client represents and warrants that:
The Client is prohibited from:
YOID may suspend access to the Portal immediately and without prior notice upon indications of fraudulent use, anomalous behavior, or breach of these T&C.
YOID shall not be liable for damages arising from failures in Iberpay's infrastructure, from banks not adhering to the VALITIC scheme, from force majeure, or from acts attributable to the Client or to third parties unrelated to YOID.
Under no circumstances shall YOID be liable for indirect damages, loss of business, loss of profit or consequential damages, regardless of their nature and cause.
Claims against YOID shall lapse after twelve (12) months from the event giving rise to them.
With respect to the personal data of the holders whose bank account is subject to verification, and for the purposes of Regulation (EU) 2016/679 ("GDPR") and Organic Law 3/2018 ("LOPDGDD"):
YOID undertakes to: (i) process the data solely for the purpose of verification; (ii) apply appropriate technical and organizational measures to guarantee the security, confidentiality and integrity of the data; (iii) not disclose the data to third parties except where legally required or to necessary sub-processors; (iv) delete or return the data upon termination of the contractual relationship, retaining only the technical records necessary for traceability, billing and regulatory compliance for the minimum required period; and (v) assist the Client in complying with its security obligations and in responding to data subject rights.
Sub-processor: To provide the VALITIC service, Iberpay (Sociedad Española de Sistemas de Pago, S.A., Tax ID A82814211) acts as a necessary sub-processor, channeling the query to the bank issuing the account. The Client expressly accepts this sub-processing arrangement by accepting these T&C.
The price of the service is that corresponding to the plan or pack selected during the contracting process, in accordance with the rates published on the Portal. Prices shown on the Portal do not include VAT.
Payment is made by credit or debit card through Stripe Payments, an external payment platform. YOID does not store payment method data. For monthly or annual subscription plans, charges are made automatically at the start of each period. For the 200 Pack, the charge is a one-time payment at the time of contracting. The payment confirmation generated by Stripe constitutes proof of charge; it does not constitute an invoice for tax purposes.
YOID will issue the statutory invoice in accordance with the Bizkaia regional tax regulations (Batuz/TicketBAI system) and will send it to the Client together with the Portal access credentials and the assigned payment account details, within a maximum of 48 business hours from payment confirmation. For any query or incident relating to billing: clientes@yoid.es.
Cancellation: The Client may cancel its subscription at any time before the start of the next billing period, by writing to clientes@yoid.es. Cancellation will take effect at the end of the current period.
YOID may modify its rates with a minimum notice of thirty (30) days communicated by email. If the Client does not cancel its subscription before the new rate's effective date, it will be deemed to have accepted it.
YOID may update these T&C with a minimum notice of fifteen (15) days communicated by email to the address provided at contracting. Continued use of the service after the effective date of the amendments shall constitute acceptance thereof. If the Client does not accept the amendments, it may cancel its subscription in accordance with Section 7.
These T&C are governed by Spanish law. To resolve any dispute arising from their interpretation or performance, the parties expressly submit to the Courts of Bilbao, waiving any other jurisdiction that may apply to them.
